Visit Vineyards.com Membership Terms and Conditions:
In these Terms and Conditions:
- "Card" means your VisitVineyards.com Temporary or Permanent Membership Card. "Member" means the person who has received a current VisitVineyards.com Membership Card.
- "Participating Retailers" means a person or organisation which has agreed to offer certain benefits to card holders.
- "VisitVineyards.com", "we" or "us" means all business activities of Visit Vineyards Pty Limited trading as VisitVineyards.com (A.C.N. 128 697 950).
- "VisitVineyards.com system" means your purchase or acceptance of a VisitVineyards.com Membership Card and/or the subsequent use of your VisitVineyards.com Membership Card to receive benefits or offers from participation retailers.
The VisitVineyards.com system
- The system is operated by VisitVineyards.com in conjunction with Participating Retailers.
- Participation in the VisitVineyards.com system is offered to card holders (Members) at the discretion of VisitVineyards.com
- We may change these Terms and Conditions at any time without prior notice and we reserve the right to suspend or terminate the system at any time without prior notice.
- Amendments to these terms and conditions will be posted on the VisitVineyards.com website.
- Your participation in the VisitVineyards.com system and your use of the card is subject to these Terms and Conditions (as varied from time to time).
- Your participation in the VisitVineyards.com system will be taken as your acceptance of these Terms and Conditions.
The benefits
- The benefits available to Members are listed on the VisitVineyards.com website, the Member booklet, by mobile phone/PDA and in general advertising material.
- All benefits are subject to availability and other terms and conditions which may be imposed by participating retailers as listed on the VisitVineyards.com website, and are correct at time of publication.
- The benefits are available to VisitVineyards.com Members only and cannot be sold, transferred, assigned or otherwise dealt with except with the consent of VisitVineyards.com.
- To claim a benefit, you must communicate to the participating retailer that you are a VisitVineyards.com Member and that you wish to obtain a benefit under the VisitVineyards.com system:
- If you contact the participating retailer by telephone you must notify the participating retailer that you are a VisitVineyards.com Member and quote your valid Membership number and expiry date.
- In a face-to-face transaction and when claiming your benefit you must present your valid VisitVineyards.com Membership card.
- In a web-based transaction you must enter your card number or any other method of identification that may be required by the participating retailer.
- We take all reasonable care to ensure that information we publish in relation to the VisitVineyards.com system is accurate but do not accept any liability relating to information provided by third parties. All descriptions of benefits we publish are based on information supplied by participating retailers, and are subject to their discretion.
- In general, benefits cannot be claimed with any other offer(s).
- Unless otherwise stated, benefits are valid to 31 August 2009, after which time they may either be extended or alternative benefits offered. Benefits may change without notice (although we request advance notice from our participating retailers).
Participating retailers and transactions
- Under the VisitVineyards.com system, we arrange for Participating Retailers (our Partners) to offer certain benefits (including discounts, upgrades or other offers) to VisitVineyards.com Members. Participating Retailers are not the agents of the VisitVineyards.com and have no authority, express or implied, to bind the VisitVineyards.com or to make any representations, warranties or statements on the VisitVineyards.com's behalf.
- We are not a party to any transactions entered into between a Member and a Participating Retailer.
- We are not liable in any way for:
- loss or any use of your details or your VisitVineyards.com card or Membership by another person, with or without your consent;
- any failure by you to notify a participating retailer that you are seeking a benefit under the VisitVineyards.com system when purchasing goods or services;
- any failure by you to activate your temporary Membership card within the prescribed period;
- the accuracy, validity or availability of benefits offered by participating retailer for any reason;
- a failure by a participating retailer to comply with the terms of any transaction you enter into with the participating retailer;
- the suspension and/or termination of the VisitVineyards.com system;
- any delay in getting a replacement VisitVineyards.com card to you;
- any liability for the condition, suitability, quality, fitness or safety or warranty as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the system to you by a participating retailer is excluded to the fullest extent permitted by law.
- Any liability of VisitVineyards.com for breach of a warranty implied by law is limited to supplying or paying the cost of supplying the VisitVineyards.com services again, at VisitVineyards.com's option.
- Any liability relating to the payment of tax, including GST, which arises from your participation in the system by virtue of your purchasing any goods or services from a participating retailer, which is your responsibility.
- Participating Retailers may forward your name, email address and phone number to VisitVineyards.com when you purchase or accept a complimentary VisitVineyards.com Membership card.
Complaints and Refunds
- If you have any issues with the service you receive at one of our Participating Retailers, you should in the first instance take this matter up with them.
- If that does not resolve your concern, then please email us and tell us, and we will respond asap. (Please allow time for us to contact the retailer in question).
- You may also send a written report to The Service Manager, VisitVineyards.com, PO Box 488, North Hobart, Tasmania, 7002, or contact us on (03) 6248 4476 or by fax to (03) 6248 5076.
- If you are unhappy with your Membership of VisitVineyards.com please email us and we will investigate your concern. Please note that your Membership is not refundable unless you can demonstrate that you participated in a VisitVineyards.com offer or experience, and it did not meet the specification(s) as outlined by the Participating Retailer, and that all attempts to resolve this with the retailer in question have failed. We are then more than happy to investigate the situtation futher.
- No refunds will be issued if you fail you use your VisitVineyards.com Membership or fail to validate your Temporary Membership Card (if applicable) within the specified time period (if applicable).
- You must notify us within 2 months (60 days) of your order/payment if you do not receive your VisitVineyards.com Membership card or any other materials posted to you, for us to issue replacements. Requests after that time will be subject to our discretion and availability.
- We are not liable for any failure to receive your monthly newsletter if you incorrectly specifly your email address, change your email address and fail to update your details with us, or if you or your business mail server (if used) have not whitelisted VisitVineyards.com as a 'safe sender' or added us to your address book, so that our newsltters can be delivered to your inbox. Refunds will not be issued if you do not receive your newsletters for reasons beyond our control, of if you fail to open them.
- If, after a year of Membership you can demonstrate that you participated in the VisitVineyards.com program and you consider that you did not get value equivalent to your annual Membership fee, please email us describing your experiences, and we will refund your money or offer you a free year of Membership at our discretion. We want our Members to be happy.
Privacy
- Information on how VisitVineyards.com handles your personal information is explained in our Privacy Policy.
- You should refer to participating retailers for a copy of their privacy policy and for information on how they handle your personal information.
Release and Indemnity
You hereby waive, release, forgive, discharge and relinquish any and all claims that you now have or may have against VisitVineyards.com, its affiliates, subsidiaries, parents, shareholders, directors, officers, employees, agents and representatives which are connected with, arise out of, relate to or are incidental to any transaction.
You hereby agree to indemnify, defend and hold VisitVineyards.com, its affiliates, subsidiaries, parents, shareholders, directors, officers, employees, agents and representatives harmless from and against any and all claims, loss, damage, tax including GST, liability and/or expense that may be incurred by VisitVineyards.com, its affiliates, subsidiaries, parents, shareholders, directors, officers, employees, agents and representatives arising out of or in connection with the performance of its duties as described in these terms and conditions including the legal costs, fees and expenses of defending itself against any claim by any or all of the parties to any transaction and/or by any other person and/or as a result of you taking any action or refraining from taking any action or instituting or defending any action or legal proceeding.
You further agree to indemnify and hold VisitVineyards.com, its affiliates, subsidiaries, parents, shareholders, directors, officers, employees, agents and representatives harmless from any claim or demand, including reasonable lawyers' fees, made by any third party due to or arising out of your use of the Website or other services, the breach of these terms and conditions, or the infringement of any intellectual property or other right of any person.
Variation of these Terms and Conditions
VisitVineyards.com may change these terms and conditions from time to time. Any changes will be posted on the Website. You are responsible for reviewing the Website to ensure compliance with these terms and conditions (as varied from time to time).
